• Video Archives (VODs): Past stream recordings with searchable highlights and timestamps
• AI-Powered Intelligence: Automated analysis of scanner traffic using OpenAI GPT models and xAI Grok, including driving intelligence reports, traffic analysis, and incident summaries
• Interactive Chat (Trunkie Chat): Real-time community chat powered by GetStream.io with moderation via WebPurify profanity filtering
• Points and Rewards System: Virtual points earned through stream participation, redeemable for badges, tiers, and leaderboard rankings
• Casino/Gaming Features: Virtual gambling games using earned points (no real money involved)
• Stream Commands: Interactive chat commands including !highlight (mark stream moments) and !golive (authorized stream initiation)
• User Profiles: Twitch OAuth authentication, personalized profiles, badge collections, and tier progression
• Notifications: Discord webhooks for stream status updates and VOD availability
• Weather and Location Data: Real-time weather via OpenWeather API and Google Maps integration for Brazoria County coverage area

3. Public Nature of Scanner Audio

All police scanner audio transmitted on this Site is:

• Considered public information under Texas Public Information Act (Chapter 552, Texas Government Code)
• Available to anyone with appropriate receiving equipment
• Not subject to privacy protections applicable to private communications

By using this Site, you acknowledge that scanner audio does not constitute confidential, private, or protected information.

4. User Conduct and Prohibited Activities

You agree not to:

1. Use the Site for any unlawful purpose or in violation of these Terms
2. Interfere with emergency services or law enforcement activities based on information obtained from the Site
3. Attempt to identify or locate specific individuals (victims, witnesses, or suspects) mentioned in scanner traffic
4. Visit specific addresses mentioned in scanner audio
5. Harass, threaten, or harm any person or entity
6. Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
7. Use automated systems (bots, scrapers, crawlers) to access the Site without our express written permission
8. Interfere with or disrupt the Site or servers connected to the Site
9. Transmit viruses, malware, or any other malicious code
10. Collect or store personal data about other users without their consent
11. Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site

5. Intellectual Property Rights

5.1 Site Content

Except for scanner audio (which is public information), all content on the Site, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, software, and the compilation thereof (the "Site Content") is the property of BC Scanner or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

5.2 Scanner Audio

Scanner audio broadcast on the Site is public information and is not subject to copyright protection. However, our specific compilation, arrangement, and presentation of this audio may be protected.

5.3 AI-Generated Content

Intelligence reports and summaries generated by artificial intelligence systems (including but not limited to xAI Grok and OpenAI services) are provided for informational purposes. While we retain rights to our AI-generated content, you may not represent such content as your own original work.

5.4 User-Generated Content

By submitting content to the Site (including chat messages, highlight markers, and stream titles via commands like !highlight or !golive), you grant BC Scanner a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content.

6. Third-Party Services

The Site integrates with and displays content from third-party services, including but not limited to:

• Twitch: Live streaming, chat services, and OAuth user authentication
• YouTube: Video hosting, live streaming, and viewer analytics
• Kick: Live streaming platform integration

6.2 AI and Analysis Services

6.3 Chat and Moderation

• GetStream.io: Real-time chat infrastructure powering Trunkie Chat

• Botrix: Multi-platform chat bot for Kick and YouTube
• Nightbot: Automated chat moderation and custom commands

6.4 Infrastructure and APIs

• Cloudflare: Content delivery network (CDN), DDoS protection, and page caching
• OpenWeather (One Call API 3.0): Real-time and historical weather data
• Google Maps API: Interactive maps and geocoding for coverage area display
• Crimeometer API: Crime statistics and public safety data aggregation

6.5 Communication Services

• Discord: Webhook notifications for stream alerts, VOD uploads, and community announcements

Your use of these third-party services is subject to their respective terms of service and privacy policies. BC Scanner is not responsible for the practices, policies, content, availability, or performance of these third parties.

7. Disclaimer of Warranties

THE SITE AND ALL CONTENT, SERVICES, AND PRODUCTS PROVIDED THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement
• Warranties regarding accuracy, reliability, or completeness of scanner audio or AI-generated content
• Warranties that the Site will be uninterrupted, timely, secure, or error-free
• Warranties regarding results obtained from use of the Site

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BC SCANNER, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or use
• Personal injury or property damage
• Business interruption
• Loss of goodwill or reputation
• Any damages arising from reliance on scanner audio or AI-generated content
• Any damages arising from actions taken based on information obtained from the Site

IN NO EVENT SHALL BC SCANNER'S TOTAL AGGREGATE LIABILITY EXCEED ONE HUNDRED DOLLARS ($100.00) USD.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless BC Scanner, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to:

• Your violation of these Terms
• Your use or misuse of the Site
• Your violation of any law, regulation, or third-party right
• Any content you submit to the Site
• Any actions taken based on information obtained from the Site

The Site uses artificial intelligence (AI) systems to generate intelligence reports. You acknowledge and agree that:

12. Points, Rewards, and Virtual Economy

12.1 Virtual Points System

BC Scanner operates a virtual points system where users can earn points through:

• Watching live streams
• Participating in chat
• Completing daily activities
• Special events and promotions

IMPORTANT: Points have no monetary value and cannot be exchanged for real currency, goods, or services. Points are virtual tokens for entertainment purposes only.

12.2 Casino and Gaming Features

The Site includes virtual casino games (slots, roulette, etc.) that use earned points as wagers. You acknowledge and agree that:

• All casino games are for entertainment purposes only and involve NO REAL MONEY
• Virtual gambling does not constitute actual gambling under Texas or federal law
• Point balances, winnings, and losses are purely cosmetic and have no real-world value
• We reserve the right to adjust, reset, or modify point balances at any time
• You must be aware of local laws regarding virtual gambling in your jurisdiction
• Casino features may be disabled or modified without notice

12.3 Badges, Tiers, and Leaderboards

• Permanent ban from all BC Scanner services
• Possible legal action for fraud or computer crimes

13. Trunkie Chat and User Communication

13.1 Chat Services

BC Scanner provides "Trunkie Chat," a real-time chat service powered by GetStream.io. By using Trunkie Chat, you agree to:

• Comply with GetStream.io's Terms of Service and Acceptable Use Policy
• Refrain from posting profanity, hate speech, threats, or illegal content
• Respect other users and avoid harassment or bullying
• Not share personal information about yourself or others
• Not attempt to impersonate other users or administrators

13.2 Automated Content Moderation

All chat messages are automatically scanned by WebPurify profanity filtering. Messages containing prohibited content will be:

• Automatically blocked before being posted
• Logged for moderation review
• May result in warnings, temporary mutes, or permanent bans

13.3 User Profiles and Authentication

Users may create profiles by authenticating via Twitch OAuth. By creating a profile, you:

• Grant us access to your Twitch username and profile picture
• Agree that your profile data may be publicly visible
• Understand that profile deletion does not delete chat history or earned points

13.4 Chat Data Retention

Chat messages are retained for 30 days for moderation purposes and may be stored indefinitely if they violate our policies or are flagged for review.

14. Stream Commands and User Features

14.1 Highlight Command

Users may use the !highlight command in stream chat to mark timestamps during live streams. By using this command, you acknowledge that:

• Your username will be logged with the highlight timestamp
• Your message accompanying the highlight may be stored and displayed
• Highlight data may be used to create video compilations
• Highlights are publicly visible to all users
• We reserve the right to remove or modify highlights at our discretion
• Commands are rate-limited to prevent spam (typically 30-second cooldown)

14.2 Go Live Command

Authorized users may use the !golive command to initiate streams. This feature:

• Is restricted to whitelisted usernames only (bcscanner, laidoffjanitor)
• Is rate-limited to prevent abuse (5 requests per minute)
• May trigger Discord notifications to community members
• Creates public stream records visible on the Site
• Allows custom stream titles via optional message parameter

14.3 Other Chat Commands

Additional bot commands may be available via StreamElements, Botrix, and Nightbot. Command usage is subject to rate limits and moderation policies.

14.4 Abuse and Misuse

Abuse of chat commands, including spam, harassment, or attempts to disrupt the Site, will result in immediate revocation of access and may result in permanent ban from all BC Scanner services.

15. DMCA and Copyright Compliance

We respect intellectual property rights. If you believe that content on the Site infringes your copyright, please provide us with written notice containing:

• A physical or electronic signature of the copyright owner or authorized agent
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material claimed to be infringing and its location on the Site
• Your contact information (address, telephone, email)
• A statement that you have a good faith belief that the use is not authorized
• A statement that the information provided is accurate and you are authorized to act on behalf of the copyright owner

Please note that scanner audio is public information and generally not subject to copyright claims.

16. Modifications to Terms

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Brazoria County, Texas, and you irrevocably consent to the jurisdiction and venue of such courts.

18. Dispute Resolution

Before filing a lawsuit, you agree to first contact us at the email address below and attempt to resolve any dispute informally. If a dispute cannot be resolved within sixty (60) days, either party may pursue legal action.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

20. Entire Agreement

These Terms, together with any privacy policy or other legal notices published on the Site, constitute the entire agreement between you and BC Scanner regarding the use of the Site and supersede all prior or contemporaneous communications and proposals.

21. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of BC Scanner.

22. Assignment

You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms without restriction.

23. Termination

We reserve the right to terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

Upon termination, your right to use the Site will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
